By accessing and using LogoVerify, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

LogoVerify provides trademark similarity analysis using AI-powered visual recognition technology. Our service compares uploaded designs against USPTO registered trademark data to identify potential conflicts.

4. No Guarantees

While we strive for accuracy, we do not guarantee that our search results are complete, current, or error-free. We are not liable for any decisions made based on our analysis. The service is provided on an "as is" and "as available" basis without warranties of any kind.

5. User Responsibilities

You are responsible for ensuring you have the right to upload and analyze any designs submitted to our service. You agree not to use our service for any unlawful purpose or in violation of these terms.

6. Account Registration and Security

You may need to create an account to access certain features of LogoVerify. When creating an account:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You must not share your account with others
• You agree to notify us immediately of any unauthorized access
• You are responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

7. Usage Limits and Fair Use

Free accounts are limited to 5 searches per month with up to 10 results per search. Additional usage may require upgrading to a paid plan.

You agree not to:

• Exceed your allocated usage limits through technical means
• Create multiple accounts to bypass usage restrictions
• Use automated tools to perform bulk searches without authorization
• Resell or redistribute search results to third parties

We employ rate limiting to ensure fair access for all users. Violation of these limits may result in temporary or permanent account suspension.

8. Intellectual Property and Data Ownership

You retain all ownership rights to designs and images you upload to LogoVerify. By uploading content, you grant us a limited license to:

• Process and analyze your uploaded images for trademark comparison
• Store your images temporarily for the purpose of providing our services
• Use anonymized data for improving our AI algorithms

We will:

• Never sell your uploaded designs to third parties
• Delete uploaded images within 30 days unless you save them to your account
• Respect your intellectual property rights at all times

Our service, including our AI models, algorithms, website design, and branding, are protected by copyright and trademark laws. You may not copy, reverse engineer, or create derivative works without our express written permission.

9. Prohibited Conduct

You agree not to use LogoVerify to:

• Upload content that infringes on third-party intellectual property rights
• Submit illegal, offensive, or harmful content
• Harass, threaten, or impersonate others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or extract data through automated means without permission
• Violate any applicable laws or regulations

We reserve the right to remove content and terminate accounts that violate these prohibitions without prior notice.

10. Termination

You may terminate your account at any time by contacting us at legal@logoverify.com or through your account settings.

We reserve the right to suspend or terminate your access to LogoVerify at any time for:

• Violation of these Terms of Service
• Fraudulent or abusive behavior
• Non-payment of fees (for paid accounts)
• Extended periods of inactivity
• Legal or regulatory requirements

Upon termination:

• Your access to the service will cease immediately
• Saved searches and account data may be deleted after 30 days
• Any prepaid fees are non-refundable unless required by law

11. Third-Party Services and Data

LogoVerify integrates with third-party services including:

• Google OAuth for authentication
• USPTO TESS database for trademark data
• Payment processors (if applicable)

We are not responsible for:

• The accuracy or completeness of USPTO trademark data
• Availability or performance of third-party services
• Third-party privacy practices (please review their respective privacy policies)

USPTO trademark data is publicly available and provided "as is." We make no representations about the accuracy, currency, or completeness of this data.

12. Privacy Policy

Your use of LogoVerify is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our service, you consent to our privacy practices as described in the Privacy Policy available at /privacy.

13. Limitation of Liability

LogoVerify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service.

14. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.
