How Etsy actually handles trademark complaints
Etsy does not proactively scan listings against the USPTO database. The system is complainant-driven: a trademark owner files a report, Etsy reviews it for completeness, and — if it meets policy — the listing is removed within 24-72 hours.
Etsy's DMCA counter-notice — the one that restores removed listings after 10 business days if the complainant doesn't sue — only applies to copyright claims. For trademark takedowns there is no equivalent statutory counter-notice. Restoring a trademark removal usually means negotiating directly with the rights holder, or showing Etsy that the underlying mark is invalid.

Etsy does not decide trademark validity itself. It removes a listing when a registered intellectual property owner (or authorized agent) files a report citing a specific registration. Etsy reviews for completeness, then removes if the report meets policy. The 2024 Transparency Report shows 85% of submitted IP reports resulted in some removal — meaning if a brand reports your listing, it's very likely coming down.

For trademark removals, there's no equivalent counter-notice in U.S. law — the practical path is to negotiate directly with the rights holder, or to contact Etsy support with evidence that you're not infringing.
